Copyright Policy (DMCA)

PastExam respects the rights of copyright owners and expects its users to do the same. We respond to notices of claimed infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

1. Designated agent

Send copyright notices and counter-notices to our designated agent:

This designation is on file with the U.S. Copyright Office: PastExam’s entry in the DMCA Designated Agent Directory.

2. Sending a takedown notice

If you believe material on PastExam infringes your copyright, send a written notice that includes:

1. your physical or electronic signature;
2. identification of the copyrighted work you claim is infringed (or a representative list if there are several);
3. identification of the infringing material and information to locate it — for example the share link, or the college, major, course name and file name;
4. your name, mailing address, telephone number and email address;
5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

When we receive a notice that meets these requirements, we remove or disable access to the material promptly. The file then disappears from the uploader’s My Notes list; the uploader may respond with a counter-notice as described below.

3. Counter-notice

If your file was removed and you believe this was a mistake or misidentification, you may send our agent a counter-notice that includes:

1. your physical or electronic signature;
2. identification of the material that was removed and where it appeared before removal;
3. a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district of your address (or, if you are outside the United States, any judicial district in which PastExam may be found), and that you will accept service of process from the person who sent the original notice or their agent.

Because PastExam accounts have no email address, include your PastExam username so we can identify your file. We will send a copy of the counter-notice to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we will restore the material 10 to 14 business days after receiving the counter-notice.

4. Repeat infringers

We permanently close the accounts of users who repeatedly upload infringing material, and delete their files.

5. False claims

Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you are not sure whether material infringes your copyright, consider speaking to a lawyer first.
